A shootout that ensued Thursday between a police office and a street peddler in New York‘s Times Square has left the suspect dead, with no one else harmed, considering that the area was crowded with tourists and holiday shoppers.

Gunfire was exchanged when a police sergeant from New York’s police force, a member of a task force against street peddlers, walked up to two men on the street selling CDs, according to a statement by NYPD Deputy Commissioner Paul Browne. One of the men pulled out a Mac-10 pistol while trying to flee, and shot two rounds at the officer, missing him both. The officer fired back and hit the suspect.

The 25-year-old suspect was pronounced dead later that day at a hospital.

The suspect’s first shot hit a window at New York’s Marquis Theater, while the second hit a nearby souvenir shop. The suspect’s gun apparently jammed, preventing the suspect from firing any further, according to Browne. The gun still had 28 rounds in it.
